DUI PENALTIES
Driving is a privilege, not a right. When charged with driving under the influence (DUI) of alcohol or drugs, the law dictates that a person no longer deserves that privilege. Because of this, DUI penalties can be very harsh; up to and including:
License suspension/revocation
Interlock device
Classes
Fines
Possible jail time
First DUI Offense
Fines
- From $400 up to $1000
Driver’s License Penalties
- 90 days suspension and a $35 civil penalty fee
- A restricted license may be an option after 45 days
Jail Time
- From 2 days to 6 months in jail OR 24 hour to 96 hours of community service
Classes
- Attend a Victim Impact Panel
- DUI School (8 hours)
Interlock Device
- Blood Alcohol Content (BAC) <0.18 = Court may order the Interlock Device for 3 to 6 months
- Blood Alcohol Content (BAC) of 0.18 or greater = 12 months to 36 months Second DUI Offense
Second DUI Offense (Within 7 Years)
Fines
- From $750 up to $1000; OR
- 100 to 200 hours of community service
Driver’s License Penalties
- 1 year revocation
- Possible suspension of car registration
Jail Time
- Minimum 10 days up to 6 months in jail or on house arrest
Classes
- Possible substance abuse treatment program
Interlock Device
- Court may order the Interlock Device for 12 to 36 months
Third DUI Offense (Within 7 Years)
Fines
- From $2000 up to $5000
Driver’s License Penalties
- 3 year suspension or revocation
- 5 day suspension of car registration
- $35 civil penalty fee
Jail Time
- From 1 year up to 6 years in prison
Classes
- Attend a Victim Impact Panel
- Alcohol and drug evaluation
Interlock Device
- Interlock Device for 12 to 36 months
DUI While Transporting a Child (Under the age of 14)
Fines
- Up to $1000
